Liability Waiver

This Liability Waiver (“Waiver”) is a binding legal document that limits the liability of TEAM EVERGREEN LIMITED (referred to as “we”, “us”, or “our”) and outlines your responsibilities when using our products and website. By purchasing, using, or handling any item sold by us, you agree to the terms set forth below. If you do not agree, you must not purchase or use our products.

1. Nature of Products

Our products are smoking accessories – including pipes, lighters, filters, stems, and related hardware. They are designed and manufactured for use with traditional legal herbs and tobacco products. We do not sell tobacco, nicotine, or any controlled substances. All items are sold as collectible, handcrafted accessories and are not intended to diagnose, treat, cure, or prevent any medical condition.

2. User Responsibility and Legal Compliance

You, the buyer and user, are solely responsible for ensuring that your purchase, possession, and use of our products comply with all applicable local, state, national, and international laws. Laws regarding smoking accessories vary significantly by jurisdiction. You must verify that you are legally permitted to own and use these items in your area.

• You confirm that you are at least 21 years old (or the legal age in your jurisdiction, whichever is higher).
• You agree not to use any product in a manner that violates the law, including but not limited to the use of illegal substances.
• You accept that we are not responsible for any fines, penalties, confiscations, or legal actions taken against you by local authorities.

3. Health and Safety Disclaimer

We make no representations or warranties regarding the health effects of using our products. Smoking or vaporising any substance carries inherent health risks, including respiratory issues and other medical conditions. You are strongly encouraged to consult a qualified healthcare professional if you have any concerns.

Our pipes and accessories are manufactured with materials commonly used in the industry (briar, meerschaum, acrylic, stainless steel). However, individual sensitivities or allergic reactions may occur. We disclaim all liability for any adverse health effects, injuries, or allergic reactions arising from the use of our products.

4. Lighter Safety and Butane Gas

All lighters are shipped completely empty of butane gas to comply with international transport safety regulations (IATA). You are solely responsible for refilling the lighter with high‑purity butane and for handling the lighter safely after receipt.

• Never overfill a lighter.
• Keep lighters away from heat sources, open flames, and direct sunlight.
• Store lighters out of reach of children and pets.
• Use only high‑quality butane gas; cheap or impure gas can damage the lighter or cause malfunction.

We are not liable for any burns, fires, explosions, property damage, or personal injuries caused by improper handling, refilling, or use of lighters sold by us.

5. Limitation of Liability

To the fullest extent permitted by applicable law, TEAM EVERGREEN LIMITED shall not be held liable for:

• Any indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use our products.
• Loss of profits, data, goodwill, or other intangible losses.
• Damage to personal property, including but not limited to furniture, clothing, or other items caused by fire, smoke, or spillage.
• Personal injury, illness, or death resulting from product use, misuse, or modification.

6. Indemnification

You agree to defend, indemnify, and hold harmless TEAM EVERGREEN LIMITED, its owners, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your misuse, abuse, or alteration of any product.
• Your violation of any applicable law or regulation.
• Any claim that your use of our product infringes upon the rights of a third party.
• Any injury or damage caused by your failure to follow safety guidelines or product instructions.

7. No Warranty on Consumable Parts

Certain components – such as O‑rings, seals, filters, and flints – are considered consumable and subject to normal wear and tear. We do not warrant these parts against degradation over time, nor do we guarantee their longevity. Replacement parts are available separately, and permanent spare stock is maintained for all discontinued models.

8. Product Modifications

Any modification, alteration, or customisation of our products performed by you or a third party not authorised by us voids all liability coverage for that item. We are not responsible for the performance, safety, or legal compliance of modified items.

9. Governing Law and Jurisdiction

This Liability Waiver, and any dispute arising from your purchase or use of our products, shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region. Any legal proceedings shall be brought exclusively in the courts of Hong Kong. By purchasing from us, you waive any objection to the jurisdiction of these courts.

10. Severability

If any provision of this Waiver is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The invalid provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if that is not possible, it shall be severed.
