Welcome to TEAM EVERGREEN LIMITED (referred to as “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and any products purchased through it. By using our site and placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Age Restriction

Our products are intended for adults only. You must be at least 21 years old to browse this site or place an order. By completing a purchase, you confirm that you are 21 or older. We reserve the right to verify your age at any stage; orders may be cancelled and refunds reduced by shipping costs if age verification fails.

2. Products and Orders

All items are hand‑finished in small batches. While we make every effort to display accurate descriptions, slight variations in colour, grain, or finish are natural and do not constitute defects. We reserve the right to adjust product listings, discontinue items, or correct pricing errors without prior notice.

We may cancel any order if stock is insufficient or if we detect suspicious activity. In such cases, you will be refunded in full.

3. Pricing and Payment

Prices are shown in the currency selected at checkout (HKD or USD, as applicable). We accept major credit cards (Visa, MasterCard, American Express) via secure third‑party payment gateways. We do not store your CVV or full card details. By providing payment information, you authorise us to charge the total amount including applicable shipping and taxes.

4. Shipping and Delivery

We ship from our Hong Kong workshop. Orders are normally dispatched within 48 business hours (Monday–Friday, 10:00–18:00 HKT). You will receive a tracking number via email once your parcel leaves our facility.

International shipping: customs duties, import taxes, and any handling fees imposed by the destination country are the sole responsibility of the buyer. Delivery times vary by destination and are estimates only; we are not liable for delays caused by customs or carriers.

Restricted Destinations – Sanctions Compliance

We strictly comply with international trade and sanctions regulations. We do not accept orders from or ship to the following countries/regions:

• Afghanistan
• Belarus
• Burundi
• Cuba
• Iran
• Iraq
• Libya
• Myanmar
• North Korea
• Russia
• Somalia
• South Sudan
• Sudan
• Syria
• Ukraine
• Venezuela
• Yemen

Orders with billing or shipping addresses in these locations will be automatically rejected at checkout. If you attempt to place an order using a forwarding address to any of these territories, we reserve the right to cancel the order and deduct any processing fees. You are solely responsible for ensuring your delivery address is not subject to these restrictions.

Lighter Shipping Restriction

All lighters are dispatched without butane gas to comply with international air transport safety regulations (IATA). Product pages clearly state this; you must fill the lighter with butane locally after receipt.

5. Returns and Refunds

We offer a 30‑day return policy for most items. To be eligible, products must be:

• Returned within 30 days of delivery;
• Unsmoked, unused, and in their original packaging;
• Accompanied by the original order confirmation or receipt.

Return shipping costs are borne by the buyer unless the item is defective or we made an error. Smoked pipes cannot be returned unless they have a manufacturing fault. Please contact us at hello@shmovew.com to obtain a return authorisation before sending any item back.

6. Repair and Spare Parts

We maintain a permanent inventory of stems, filters, and seals for all discontinued models. If you need repair or replacement, send a photo and we will identify the correct part. Bench repairs are quoted and approved before any work begins. Standard stems are usually shipped within the same week.

7. Intellectual Property

All content on this website – including text, images, logos, graphics, and design – is the exclusive property of TEAM EVERGREEN LIMITED and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. User Conduct and Prohibitions

By using our site, you agree not to:

• Engage in any unlawful or fraudulent activity;
• Interfere with the proper functioning of the website or its security measures;
• Attempt to bypass any age‑verification or payment controls;
• Use our products or content in a manner that violates any applicable local, national, or international law.

9. Export and Re‑export Compliance

You (the buyer) acknowledge that our products may be subject to export controls. You agree not to export, re‑export, or transfer any product to any country, entity, or individual on any sanctions list (including but not limited to OFAC, UN, and EU lists). You further agree not to resell our products to any of the restricted destinations listed in Section 4. Should any violation occur, you assume full liability and agree to indemnify us against any penalties, fines, or legal actions that may arise.

10. Disclaimer of Warranties

Our products are provided “as is” and “as available”. We make no warranties, express or implied, regarding the fitness for a particular purpose, merchantability, or non‑infringement, except as required by applicable law. We do not warrant that our site will be uninterrupted or error‑free.

11. Limitation of Liability

To the fullest extent permitted by law, TEAM EVERGREEN LIMITED shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our products or website, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

12. Governing Law and Dispute Resolution

These Terms and any dispute arising from your use of our site or products shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region. Any legal action or proceeding shall be brought exclusively in the courts of Hong Kong. Both parties consent to the jurisdiction of such courts.

We may update these Terms from time to time. The revised version will be posted on this page with a new “Last updated” date. Your continued use of our site after any changes constitutes acceptance of the new Terms. We encourage you to review this page periodically.
